Discovery. The Implications Of Pippins v. KPMG For The Preservation Of Evidence. Parties' discovery obligations in potential class and collective action cases recently became even more complicated. On February 3, 2012, U.S. District Judge Colleen McMahon of the U.S. District Court for the Southern District of New York ruled against KPMG's Case. On February 3, 2012, the U.S. District Court for the Southern District of New York affirmed a magistrate judge's decision requiring preservation of a massive amount of electronically stored information (ESI) in a putative class action. The decision was a setback for WLF, which filed a brief urging that the decision be overturned. Pippins v. KPMG LLP, No. 11 Civ. 377(CM)(JLC), 2012 WL 19379, at *15 (S.D.N.Y. Jan. 3, 2012). 2. Procedural History. On January 19, 2011, Plaintiffs brought this action under the FLSA and NYLL against KPMG. On April 6, 2011, Plaintiffs filed a motion seeking conditional certification of a collective action, court-authorized notice pursuant to Plaintiff / Appellant: Edward Lambert, Jamie Schindler, individually and on behalf of all others similarly situated and Kyle Pippins, individually and on behalf of all others similarly situated. In this action, Plaintiffs challenge KPMG's treatment of certain accountants in its audit practice as exempt employees under the federal Fair Labor Standards Act and New York State Labor Law.
