The court heard Mr Skoczylas originally believed he had obtained lawyers to act on both his and Scotchstone's behalf to bring a challenge. However that representation fell apart on July 31. Facts: The plaintiffs, Scotchstone Capital Fund Ltd and Mr Skoczylas, claimed damages arising out of other proceedings involving the plaintiffs. They alleged that the claim arose from "manifest infringements of EU law" by a court of last resort in Ireland's jurisdiction. Two motions were before the High Court: firstly, the plaintiffs' motion for judgment issued on the 26th of July The shareholder group is led by Piotr Skoczylas, whose Scotchstone Capital Fund bought €200,000 of Irish Life & Permanent shares in 2010. The ECJ ruled against a number of ILPG shareholders, named in the suit as Gerard Dowling, Padraig McManus, Piotr Skoczylas and Malta-based Scotchstone Capital Fund Limited. 2 The request has been made in the course of proceedings between, on the one hand, Mr Gerard Dowling, Mr Padraig McManus, Mr Piotr Skoczylas and Scotchstone Capital Fund Limited ('Scotchstone') and, on the other, the Minister for Finance ('the Minister'), where the former seek the setting aside of the direction order made by the High Messrs Gerard Dowling, Padraig McManus and Piotr Skoczylas are individual shareholders. Mr Skoczylas was also, for a period, a director of ILPGH, having been elected at an Extraordinary General Meeting of ILPGH that was held on 20 July 2011 ('the EGM').
